Terms and Conditions of Webwise/Watch Your Space’s ‘#Up2Us Safer Internet Day’ Competition (“Contest”)
By entering this Contest you (the “Contestant”) agree to be bound by these terms and conditions. Any information or instructions included on the Watch Your Space Win Prizes Contest Page (http://www.watchyourspace.ie/winprizes) (“Contest Page”) forms part of these terms and conditions. This Contest, which is being staged partially via online social networking platforms is in no way sponsored, supported or organised by any social networking company. The information you provide will be used only for the purposes of operating the Contest. You are providing your information to Webwise, PDST Technology in Education.
A. Contest Period The Contest period is from 00:00:00 (GMT) on 13/10/2014 until 23:59:59 (GMT) on 19/01/2014 (“Contest Period”).
B. Eligibility 1. The Contest is open to one category of entrant: (1) groups (“Group Entrants“). With respect to Group Entrants, the Competition is open only to groups of young people between the ages of 12 and 19 who are legal residents of the Republic of Ireland. Groups include school class groups, as well as youth groups that take place outside of schools. Eligible Individual Entrants who are legal residents of the Republic of Ireland at time of entry and are under eighteen (18) (“Minor“), must obtain their parent or legal guardian’s permission to participate in the Competition. This is an automated process facilitated through the competition website upon registration. Sponsor and each of their respective parents, subsidiaries, affiliates, distributors, retailers, sales representatives, advertising and promotion agencies and each of their respective officers, directors and employees (collectively, the “Promotion Entities“), and their respective immediate family members and/or those residing in the same household of each are ineligible to enter the Competition or win a prize.
C. How to Enter 1. There is no charge for entering this Contest. You must have access to the internet as the Contest can only be entered online.
2. To enter the contest Group Entrants should go to the Win Prizes section of the Watch Your Space website and complete the entry form, following the online instructions to upload and submit entries. Entrants should also post their entries to the Watch Your Space Facebook wall or to the Watch Your Space Twitter feed.
3. To be eligible, entrants must tag #Up2Us and mention Watch Your Space’s Account ID (@WatchYourSpace) in the caption.
4. To be eligible, Contestant must like Watch Your Space’s Facebook Account at the time of Contest Entry to win the Contest.
5. Once submitted, the provided information and uploaded file will be considered a Contestant’s Entry.
6. Videos must be uploaded in one of the following file formats: MP4, MOV, and WMV. Photos and posters must be uploaded in one of the following file formats: PDF, JPG, JPEG, PNG, GIF.
D. How to win 1. After the contest deadline of 19/1/2015 has passed, representatives of the Promotion Entities (the “Judges“) will review the Group Entrants Submissions and select a Grand Prize winning submission from among all eligible Group Entrants. Additional prizes may be awarded at the discretion of the Judges.
2. Group Entries will be judged according to the following judging criteria: a) creativity (style, message delivery, execution, etc.); b) appropriateness (on topic, etc.); and c) effectiveness (clarity of message, persuasiveness, potential for a long lasting effect etc.).
3. Winners of the Group Contest will be notified on or about week of January 26, 2015 by Sponsor, whose decisions will be final and binding and not subject to challenge or appeal on eligibility determinations and all other matters relating to this Contest. Winner selection will be subject to Sponsor’s verification of winners’ eligibility.
E. The Prize 1. Watch Your Space wristbands and badges will be sent to all Group Entrants.
2. The prize for the winning Group Entrant is for musician Gavin James, and a number of other musicians, to play a private gig for the benefit of the group. This gig will take place on Safer Internet Day (10 February 2015) and in an appropriate venue as agreed between Webwise, the winning group and the management of the artists involved.
3. The winning group must arrange and meet any costs related to hiring a suitable venue/security, running the gig and insuring the event. The winning Group should ensure the event is adequately supervised and is responsible for compliance with all health and safety standards. Webwise will provide the PA and sound engineer.
4. Prizes will be awarded “AS IS” with no warranty or guarantee, either express or implied offered by Webwise. Nothing contained herein should be construed as an endorsement by Webwise of any prize suppliers or other third party, product, or service.
5. No cash or other substitution, assignment or transfer of any prizes permitted, except by Webwise, who reserves the right to substitute a prize or prize component with cash or another prize of comparable or greater value.
F. Notification of Winners 1. Potential winners will be notified by telephone, email and/or regular mail using contact information provided at the time of entry. Sponsor shall have no liability for any winner notification that is lost, intercepted or not received by the potential winner for any reason. If any potential winner does not respond within the time required by Sponsor, or if any winner notification is returned as unclaimed or undeliverable to a potential winner, such potential winner will forfeit his/her prize and an alternate winner may be selected based on the results of the aforementioned judging criteria. If any potential winner is found to be ineligible, or if he/she has not complied with these Official Rules or declines the prize for any reason, such potential winner will be disqualified and the prize may be awarded to an alternate winner based on the results of the aforementioned judging criteria.
2. When winning entries have been confirmed and ratified they will be publically announced on the Watch Your Space Facebook and Twitter pages.
G. Publicity 1. Except where prohibited, participation in the Contest constitutes winner’s consent to Webwise’s use of winner’s name and prize information, likeness, photograph, voice, opinions, biographical information, hometown and county strictly for the purpose of running this contest.
H. Privacy and Data Protection 1. Other than as set out in these terms and conditions or for the purposes of operating the Contest, the details and information provided by you when entering the Contest or claiming a prize will not be used for any purpose other than to notify winners and for prize fulfillment purposes in connection with the Contest, nor shall they be passed to any third party. 2. Contestants’ personal information will be kept strictly confidential.
I.Representations and Warranties/Indemnification 1. Each Group Entrant that enters this Competition represents and warrants as follows: (i) the Submission is the entrant´s own original, previously unpublished, and previously unproduced work of the person(s) who created the material submitted; (ii) the Entrant can provide on request all appropriate clearances, permissions and releases for the Submission, including location releases for all recognizable locations and releases from all identifiable individuals appearing in any video entries ; (iii) the Submission does not contain any computer virus, is otherwise uncorrupted, is wholly original with entrant, and as of the date of submission, is not the subject of any actual or threatened litigation or claim; (iv) the Submission does not and will not violate or infringe upon the intellectual property rights or other rights of any other person or entity; and (v) the Submission does not and will not violate any applicable laws, and is not and will not be defamatory or libellous. Each entrant (or, if such entrant is a Minor, such Minor´s parent or legal guardian) hereby agrees to (a) not hold the Promotion Entities responsible for, and (b) reimburse the Promotion Entities in relation to, any and all third party claims, actions or proceedings of any kind and any and all damages, liabilities, costs and expenses relating to or arising out of any breach or alleged breach of any of the warranties, representations or agreements of entrant hereunder.
J. Grant of Rights: 1. Each entrant into the Competition (or, if such entrant is a Minor, such Minor´s parent or legal guardian) grants to Sponsor, and its respective designees, a non-exclusive, worldwide, perpetual, royalty-free, sub-licensable right to make use of the Submission and any person’s or other entity’s property (physical and personal and indicia) contained therein, in any media now or hereafter known, without any payment or other consideration of any kind, or permission or notification, to you or any third party. Sponsor reserves all rights, on a non-exclusive basis, including without limitation, the right to reproduce, record, alter, amend, edit, publish, publicly perform, use, broadcast and stream the Submission in connection with any and all media now or hereafter known throughout the world, in any and all media, now or hereafter known, in perpetuity, for no additional consideration. Without limiting the foregoing, Sponsor shall have the right, but not the obligation, to use the Submission in any merchandising, advertising, marketing, promotion or for any other commercial or non-commercial purpose, including, without limitation, the promotion and/or marketing of Sponsor. Individual Entrants (or, if such entrant is a Minor, such Minor´s parent or legal guardian) forever waive and relinquish all so-called “moral rights” (droit moral) now or hereafter recognised and Group Entrants warrant that they have secured waivers of such rights from their Submission’s authors.
K. General Conditions 1. Contestants must have a valid e-mail address at the time of entry. 2. By entering this Contest, you agree to these Terms and Conditions which are final and binding in all respects related to the Contest. 3. Webwise reserves the right to alter, amend, foreclose or withdraw the Contest or the terms and conditions of entry at its sole discretion at any time and without prior notice. 4. Webwise reserves the right, at its sole discretion, to disqualify any contestants deemed to be (a) tampering or attempting to tamper with the entry process or the operation of the Contest or any website of Webwise’s partners; (b) violating these Terms and Conditions; (c) acting with intent to annoy, abuse, threaten or harass any other person. 5. Any attempt by any person to deliberately damage any website or undermine the legitimate operation of the Contest is a violation of criminal and civil law, and, should such an attempt be made, Webwise reserves the right to seek damages from any such person to the fullest extent permitted by law. Webwise’s failure to enforce any term of these Terms and Conditions shall not constitute a waiver of that provision. 6. Participation in receipt of benefits from the Contest may have tax consequences. Should there be any tax liability for participation in the competition or the receipt of a prize, or costs or expenses relating to participation in the competition or for any other reasons, such taxes and/or expenses are the sole responsibility of the participant. 7. This Contest is governed by the law of the Republic of Ireland. 8. If you were selected as one of the winners, you are not allowed to use Webwise’s Facebook Fan Page (http://www.facebook.com/watchyourspace) to post messages to promote and re-sell any of the prizes. By doing so, you will be banned from any future Contests held by Webwise. 9. If for any reason the Contest is not capable of running as planned, including without limitation, infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other causes which corrupt or affect the administration, security, fairness, integrity, or proper conduct of the contest, Webwise reserves the right, at its sole discretion to cancel, delay, modify, or terminate the contest without any prior notice. 10. Webwise, its agents, and sub-contractors do not accept any responsibility for any technical failure or malfunction or any other problem with any online networked, system, server, provider, or otherwise which may result in any contents or entry into the contest not being properly recorded or uploaded. 11. Webwise shall not be liable for any disruption to the contest, whether due to technical problems or otherwise, which is beyond reasonable control. In the event of any disruption to the contest, the Samsung shall use its reasonable endeavours to remedy the disruption and resume the contest on a fair and equitable basis to the contestants. 12. The decision of Webwise is final and Webwise shall not enter into any correspondence about the results. Webwise accepts no responsibility for entries lost, misdirected, illegible, late, mutilated or altered. Entries that do not comply with these terms and conditions will be disqualified. 13. By entering the contest, you agree to release Webwise from any liability whatsoever for any claims, costs, injuries, losses, or damages of any kind arising out of or in connection with the contest or with the acceptance, possession, attendance at, or use of any prize 14. Webwise reserves the right to amend these terms and conditions at any time. All matters and disputes will be subjected to the final decision of Webwise.
